LEGAL DISCLAIMER AND LIMITATION OF LIABILITY

PLEASE READ THIS DISCLAIMER CAREFULLY.

This Disclaimer governs your booking and stay at the serviced apartments owned and operated by [Your Business Name] (the "Owner/Management"). By proceeding with a booking and checking in, the Guest acknowledges and agrees to the terms set forth in this Disclaimer and the full Terms and Conditions.

1. General Information Only

The information provided by the Owner/Management, including on its websites, booking platforms, marketing materials, and communications, is for general informational purposes only. While every effort is made to ensure the accuracy of the information, the Owner/Management makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the services or related information.

2. Limitation of Liability

To the maximum extent permitted by applicable law, the Owner/Management shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to, loss of profits, loss of data, loss of business opportunity, or property damage, arising out of or in connection with the Guest's stay, except in cases of proven gross negligence or willful misconduct by the Owner/Management or its employees.

3. Guest Safety and Personal Property

• Assumption of Risk: The Guest and all members of their party voluntarily assume all risks related to their stay, including risks of injury, property loss, or damage arising from the use of the Apartment, the Building's facilities, or common areas.

• Personal Property: The Owner/Management is not responsible for the loss, damage, or theft of any personal belongings, money, or valuables brought onto the premises or left in the Apartment or in any communal areas, including vehicles parked on the property. Guests are strongly advised to secure their belongings and purchase appropriate travel or personal insurance.

• Use of Facilities: Use of any facility within the Apartment or the Building (e.g., stairs, appliances, gym, parking) is at the Guest's own risk.

4. Third-Party Services and Force Majeure

• Services: The Owner/Management is not liable for any failure, interruption, or delay in the provision of services that are outside of its reasonable control, including but not limited to, power outages, water supply issues, internet/Wi-Fi disruption, or failure of third-party contractors or suppliers.

• Force Majeure: The Owner/Management shall not be deemed to be in breach of contract or liable for any failure to perform its obligations due to events beyond its reasonable control, including (but not limited to) acts of God, war, terrorism, natural disasters, epidemics, or government restrictions.

5. Exclusion of Warranties

All statutory or implied conditions, warranties, and representations, including those relating to fitness for a particular purpose, are excluded to the fullest extent permitted by law. The Apartment and services are provided on an "as is" and "as available" basis.

BY COMPLETING THE BOOKING AND OCCUPYING THE APARTMENT, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THIS LEGAL DISCLAIMER AND THE ACCOMPANYING TERMS AND CONDITIONS.

Terms & Conditions - the basics

General Terms and Conditions for Craigpark Residences Serviced Apartments

1. Definitions

• "Apartment" means the specific serviced apartment unit booked by the Guest.

• "Building" means the entire premises owned by Timenys Properties LTD where the Apartments are located.

• "Guest" means the person making the booking and all members of their party occupying the Apartment.

• "Owner/Management" refers to Timenys Properties LTD.

2. Booking and Payment

2.1. A booking is confirmed only upon receipt of the required deposit or full payment as specified at the time of booking and upon issuance of a written confirmation by the Owner/Management.

2.2. The Guest agrees to pay the total booking cost, including any applicable taxes, fees, and security deposits, by the due dates specified. Failure to do so may result in cancellation of the booking.

2.3. A security deposit (pre-authorisation or charge) may be required before or at check-in to cover any potential damages or excessive cleaning charges. This will be released/refunded following a satisfactory post-departure inspection.

3. Check-in and Check-out

3.1. Check-in Time: The Apartment is available for occupancy from 3:00 PM on the scheduled arrival date.

3.2. Check-out Time: The Guest must vacate the Apartment and return all keys/access fobs by 10:00 AM on the scheduled departure date.

3.3. Late Check-out: Any unauthorised late check-out may result in a penalty charge equivalent to a half-day or full-day's rent, at the discretion of the Owner/Management. Any approved late check-out must be arranged in advance and may be subject to an additional fee.

3.4. Key Return: Failure to return all allocated keys and/or access fobs upon check-out will result in a replacement fee of £50.00 per item.

4. Guest Obligations and Use of Apartment

4.1. The Guest is granted a license to occupy the Apartment for the agreed duration for the purpose of a short-term stay, and this agreement does not create a tenancy.

4.2. The maximum number of occupants for the Apartment must not exceed the number specified in the booking confirmation.

4.3. No Smoking Policy: Smoking (including e-cigarettes/vaping) is strictly prohibited in the Apartment and all common areas of the Building. A breach of this rule will result in an automatic minimum penalty charge of  £250.00 for deep cleaning and may result in immediate termination of the stay.

4.4. Noise and Nuisance: Guests must maintain acceptable noise levels and not cause a nuisance to other residents or guests in the Building, particularly between the hours of 10:00 PM and 8:00 AM. Failure to comply may result in immediate termination of the stay without refund.

4.5. Prohibited Activities: The Apartment shall not be used for any illegal, immoral, or commercial purposes. Parties or events are strictly prohibited.

4.6. Right of Entry: The Owner/Management reserves the right to enter the Apartment for maintenance, repair, inspection, or in case of emergency, providing reasonable notice where possible.

5. Damages, Loss, and Security Deposit

5.1. The Guest is responsible for taking all reasonable care of the Apartment and its contents.

5.2. Liability for Damage: The Guest is liable for any damage to the Apartment, its contents, or the Building's common areas caused by the Guest or any member of their party.

5.3. Reporting Damage: The Guest must report any breakages, damage, or maintenance issues to the Owner/Management immediately.

5.4. Charge for Damages: The Owner/Management reserves the right to charge the Guest for the full cost of repairing or replacing any damaged or lost items, including an administration fee for processing the claim. This cost will be deducted from the security deposit or charged to the payment card on file.

5.5. Excessive Cleaning: The Apartment must be left in a reasonably clean and tidy condition. The Owner/Management reserves the right to charge for excessive cleaning required beyond normal we ar and tear.

6. Public Liability and Loss of Property (Limitation of Liability)

6.1. The Owner/Management is not liable for any loss, damage, or injury to the Guest or any member of their party, or for loss or damage to their personal property, vehicles, or possessions, unless caused by the proven negligence of the Owner/Management or its employees.

6.2. Guests are advised to ensure they have adequate personal travel insurance to cover any loss or damage to personal property and for any medical or other costs in case of accident or injury.

6.3. The Owner/Management is not responsible for the malfunction or failure of any utility (e.g., electricity, water, internet) or appliance outside of its reasonable control.

7. Termination of Stay

7.1. The Owner/Management reserves the right to terminate a Guest's stay immediately and without refund if the Guest or any member of their party is in serious breach of these terms and conditions, including but not limited to: non-payment, causing damage, excessive noise/nuisance, or engaging in illegal activities.

Pet Policies

1. Pet Policy Acceptance

1.1. Acceptance of any pet must be explicitly approved by the Owner/Management prior to arrival and is subject to this separate Pet Policy.

1.2. The Owner/Management reserves the right to refuse any pet without stating a reason.

2. Pet Fee

2.1. A non-refundable Pet Fee will be charged per booking.

2.2. The Pet Fee will be calculated as 20 percent (20%) of the total accommodation cost (either the nightly rate multiplied by the number of nights, or the total amount of the booking, as specified at the time of booking).

2.3. This fee is to cover the additional cleaning and wear and tear associated with a pet and is separate from the standard security deposit.

3. Pet Owner Responsibility

3.1. The Guest is solely responsible for the control and conduct of their pet at all times.

3.2. Pets must be kept on a leash in all common areas of the Building.

3.3. Pets are NOT permitted on any furniture or bedding in the Apartment.

3.4. Pet owners must immediately clean up all pet waste inside and outside the Apartment.

3.5. The Guest must ensure that the pet does not cause excessive noise or nuisance to other guests or residents. Any complaints regarding a pet may lead to the immediate requirement for the pet to be removed from the premises.

3.6. The Guest is responsible for any and all damage caused by their pet to the Apartment, its contents, or the Building's common areas. Costs for damage or deep cleaning in excess of the standard Pet Fee will be charged to the Guest in accordance with the general Terms and Conditions for Damages.

3.7. Pets must not be left unattended in the Apartment for extended periods and should never be left alone if they are likely to cause distress or damage.
